History and Overview

International Traffic in Arms Regulations (ITAR) are mandated by the U.S. State Department as a means to control the manufacture, import and export of military products and services. These regulations center on a list of products called the U.S. Munitions List (USML), which includes a wide variety of products, as well as software, technical data and services ranging from aircraft and body armor to computers and navigation systems. An organization is subject to ITAR requirements if its products, software, technical data or services are found on the USML.

International organizations can also be subject ITAR. For example, if a non-U.S. company obtains an ITAR product abroad, that company is subject to ITAR. Any firms that manufacture, distribute, import or export products, or perform analysis, research and development or other services for the U.S. Department of Defense must act in accordance with ITAR.

To comply with ITAR, companies must meet a number of extensive requirements including registration with the U.S. State Department, limitations on the transfer of regulated software and technical data, limitations on conducting defence services for international groups, the responsibility to acquire export licenses, and requirements for proper record keeping.
